1. Acceptance of Terms
By accessing and using Extended Sessions .ai (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including both therapists who configure the Service for their patients and patients who use it as a between-session tool.
2. Description of Service
Extended Sessions .ai is an AI-powered companion tool designed to support patients between therapy sessions. The Service is configured by licensed therapists for use by their patients and is intended to supplement—not replace—ongoing therapy or professional mental health treatment.
Important: Not a Healthcare Provider or Substitute for Therapy
Extended Sessions .ai is not a healthcare provider and does not provide therapy, psychological treatment, clinical diagnosis, psychiatric care, or emergency services. The Service is a tool configured and supervised by licensed therapists, but interactions with the AI are not therapy, and the AI is not a substitute for a licensed mental health professional.
The Service is powered by Google Vertex AI (Gemini) and provides text-based conversation to help patients reflect, practice skills, and stay engaged with therapeutic concepts between sessions. All interactions are monitored for safety and crisis detection, but this monitoring is supplementary—not a guarantee of safety or a substitute for emergency services.
3. Beta Program
Extended Sessions .ai is currently offered as a beta service. As a beta product, the Service, its features, functionality, and pricing are subject to change or discontinuation at any time, at our discretion. We may modify, suspend, or terminate the Service with or without notice.
During the beta period, the Service is provided on an "as-is" basis. We make no warranties regarding the Service's availability, reliability, or fitness for any particular purpose. Users acknowledge and accept the risks associated with using beta software, including potential data loss, service interruptions, or changes to functionality.
4. Account Registration
The Service is configured by licensed therapists on behalf of their patients. To create a therapist account, you must:
- Provide proof of a valid, active license from a recognized licensing board or jurisdiction
- Verify your professional credentials during onboarding
- Maintain accurate and up-to-date information about your license, contact details, and practice information
- Create and maintain a secure password
Therapists are responsible for ensuring that patient accounts are created appropriately, that informed consent has been obtained from patients, and that all information provided is accurate and complete.
You agree not to use the Service for any unlawful purpose or in any way that violates these Terms or applicable laws. You are responsible for all activities conducted under your account.
5. Therapist Responsibilities
Therapists who use Extended Sessions .ai acknowledge and agree to the following responsibilities:
Maintain Professional License
- You must maintain a valid, active license in good standing throughout your use of the Service
- You must inform us immediately if your license status changes, is suspended, or is revoked
- You are responsible for complying with all licensing board requirements in your jurisdiction
Appropriate Configuration and Supervision
- You must configure the AI appropriately for each patient's therapeutic needs and treatment goals
- You are responsible for providing informed consent to patients and explaining that this is a tool, not therapy
- You must review patient interactions with the Service regularly to ensure the AI is functioning appropriately and safely for each individual
- You must adjust AI configuration if patient responses indicate the tool is not meeting their needs or is causing harm
Crisis Response and Safety Monitoring
- You must respond promptly to crisis alerts generated by the Service
- You understand that crisis detection is AI-assisted and supplementary only—it is not a substitute for professional crisis assessment
- You are responsible for establishing your own crisis protocols and for instructing patients to contact emergency services (911 in the US) if they are in immediate danger
Professional Liability and Malpractice Insurance
- You are responsible for obtaining and maintaining professional liability insurance that covers your use of the Service
- We do not provide malpractice insurance coverage, and you should not assume that our insurance covers your use of Extended Sessions .ai
- You are responsible for all clinical decisions and for ensuring the Service does not constitute the practice of medicine or psychology without appropriate licensing
6. Patient Responsibilities
Patients who use Extended Sessions .ai agree to:
- Use the Service as a supplement to ongoing therapy, not as a replacement for professional mental health care
- Provide honest information to the AI so it can understand your situation and provide appropriate support
- Contact emergency services immediately if you are in crisis, experiencing suicidal thoughts, or are a danger to yourself or others. Call 911 (US) or your local emergency number. You can also contact the 988 Suicide & Crisis Lifeline (call or text 988 in the US)
- Contact your therapist if you have concerns about your mental health or if the Service is not helpful
- Understand that the AI is not a therapist and cannot provide clinical diagnosis, emergency intervention, or replace professional mental health care
7. AI Limitations
Users acknowledge the following limitations of the AI-powered Service:
The AI Is Not a Therapist
The AI that powers Extended Sessions .ai is a tool designed to support reflection and skill practice. It is not a licensed therapist, does not have clinical training, and cannot provide therapy, diagnosis, or crisis intervention. The AI cannot replace human clinical judgment or professional mental health care.
Potential for Inaccurate or Inappropriate Responses
Like all AI systems, the AI may produce responses that are inaccurate, misguided, or inappropriate. It may:
- Misunderstand what you are communicating
- Provide suggestions that don't fit your situation
- Miss important safety concerns
- Generate content that feels invalidating or unhelpful
For these reasons, therapist review and oversight is essential. Patients should always discuss concerning interactions with their therapist.
Crisis Detection Is Supplementary
The Service includes AI-assisted crisis detection to flag concerning statements. However, this system:
- Is not a substitute for professional crisis assessment
- May miss genuine crises (false negatives)
- May flag non-emergent statements as concerning (false positives)
- Is not a guarantee of safety or professional intervention
In any emergency, do not rely on the Service. Contact 911 or call 988 immediately.
No Guarantee of Therapeutic Benefit
While the Service is designed to support therapeutic work between sessions, we cannot guarantee that using the Service will improve mental health outcomes, reduce symptoms, or provide any specific therapeutic benefit.
8. HIPAA Compliance and Privacy
Extended Sessions .ai is designed to be HIPAA-compliant and operates under a Business Associate Agreement (BAA) with Google Cloud Platform (GCP), our cloud infrastructure provider.
Business Associate Agreement
All therapists who use the Service must execute a BAA with Extended Sessions .ai as part of onboarding. This agreement ensures that Protected Health Information (PHI) is handled in compliance with HIPAA regulations. By using the Service, you agree to the terms of our BAA.
Privacy Policy
For complete information about how we collect, use, and protect your personal information and PHI, please review our Privacy Policy. Your use of the Service constitutes acceptance of our privacy practices.
Data Security
We maintain HIPAA-compliant infrastructure, including:
- Encryption of data in transit and at rest
- Access controls and authentication mechanisms
- Regular security assessments and updates
- Incident response and breach notification procedures in accordance with HIPAA
However, no system is completely secure. We encourage users to follow best practices for protecting their login credentials and not to share sensitive information outside of the Service.
9. Intellectual Property
Our Ownership
Extended Sessions .ai owns all rights to the Service, including its platform, code, design, features, and functionality. The Service is licensed to you for use in accordance with these Terms, but you do not own the Service.
Therapist Clinical Data
Therapists retain ownership of their clinical data, including their configuration of the AI for each patient, their therapeutic notes, and their clinical decision-making. This data is stored securely and will not be used by Extended Sessions .ai for any purpose other than providing the Service and complying with applicable law.
Patient Personal Data
Patients retain ownership of their personal information and health data. This data is controlled by the therapist and patient relationship and will be used only to provide the Service and as directed by the patient and their therapist.
Your Content
You grant us a license to use any content you provide to the Service (patient statements, therapist configurations, etc.) solely for the purpose of providing the Service, including AI learning and improvement with appropriate safeguards. You retain all ownership rights to your content.
10. Prohibited Uses
You agree not to use the Service for any of the following purposes:
- Illegal Activity: Any use that violates federal, state, or local law, or that promotes illegal activity
- Unauthorized Access or Data Extraction: Attempting to access another user's account or data, or attempting to extract PHI of individuals who are not your patients
- Reverse Engineering or Security Testing: Attempting to reverse-engineer, hack, or conduct unauthorized security testing on the Service or its infrastructure
- Automated Access: Using bots, scripts, or other automated tools to access the Service without authorization
- Abuse or Harassment: Using the Service to abuse, harass, or threaten other users
- Impersonation: Impersonating another person or misrepresenting your identity or credentials
- Clinical Misuse: Using the Service in a manner that violates professional ethics, applicable law, or that could harm patients
- Data Theft or Breach: Any attempt to steal, breach, or misuse data from the Service or its users
We reserve the right to investigate violations of these terms and to cooperate with law enforcement as appropriate.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXTENDED SESSIONS .AI (INCLUDING ITS OWNERS, OPERATORS, AND SERVICE PROVIDERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST REVENUE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Specific Limitations for Healthcare Use
Extended Sessions .ai is not liable for:
- Clinical Outcomes: Any patient outcomes, whether positive or negative, including improvement or deterioration of mental health status. The Service is a tool supervised by a therapist, and clinical outcomes depend on many factors beyond the Service's control
- AI Accuracy or Effectiveness: The accuracy, helpfulness, or therapeutic value of any AI-generated responses. Users acknowledge that AI may produce inaccurate, inappropriate, or unhelpful content
- Therapist Clinical Decisions: Any decisions made by a therapist regarding patient care, diagnosis, treatment, or crisis response. These clinical decisions are the therapist's responsibility, not ours
- Missed or Delayed Crisis Response: If the Service fails to detect a crisis, or if crisis detection is delayed. Users must rely on emergency services (911 or 988) for crisis response
- Service Interruptions: Temporary or permanent loss of access to the Service due to technical issues, maintenance, or other reasons
- Data Loss: Loss, corruption, or unauthorized access to patient data (though we maintain reasonable safeguards)
12. Termination
Termination by You
You may terminate your use of the Service at any time by ceasing to use it and, if you wish, requesting account deletion. Upon termination, your account will be deactivated, but data retention will follow the terms described in our Privacy Policy.
Termination by Us
We may terminate or suspend your account and access to the Service at any time, with or without notice, if:
- You violate these Terms of Service
- You are no longer a licensed therapist (or your license is revoked or suspended)
- We determine that your use of the Service violates applicable law or poses a safety risk
- We discontinue the Service or the beta program
- You have not used the Service for an extended period
Data Following Termination
Following termination, your data will be retained, deleted, or anonymized in accordance with our Privacy Policy and applicable law, including HIPAA's requirements for patient record retention. You will be notified of data retention and deletion procedures.
13. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the United States and applicable state law, without regard to conflicts of law principles. Any legal action or proceeding related to these Terms will be brought exclusively in the federal or state courts located in the jurisdiction where Extended Sessions .ai is based, and you agree to submit to the jurisdiction and venue of such courts.
14. Changes to Terms
We may modify these Terms of Service at any time. If we make changes, we will update the "Last Updated" date at the top of this page. Material changes to these Terms will be communicated to active users via email or through the Service.
Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must cease using the Service.
